一、特别提示
在此特别提醒您在注册成为东润智慧渔业App（以下简称“APP”）用户之前，请认真阅读本《东润智慧渔业App用户使用服务协议》（以下简称“协议”），确保您充分理解本协议中各条款。请您审慎阅读并选择接受或不接受本协议。您同意并点击确认本协议条款且完成注册程序后，才能成为APP的正式注册用户，并享受APP的各类服务。您的注册、登录、使用等行为将视为对本协议的接受，并同意接受本协议各项条款的约束。若您不同意本协议，或对本协议中的条款存在任何疑问，请您立即停止APP用户注册程序，并可以选择不使用本APP服务。
本协议约定APP与用户之间关于“东润智慧渔业App”服务（以下简称“服务”）的权利义务。“用户”是指注册、登录、使用本服务的个人、单位。本协议可由APP随时更新，更新后的协议条款一旦公布即代替原来的协议条款，恕不再另行通知，用户可在本APP中查阅最新版协议条款。在修改协议条款后，如果用户不接受修改后的条款，请立即停止使用APP提供的服务，用户继续使用APP提供的服务将被视为接受修改后的协议。
二、账号注册
1、用户在使用本服务前需要注册一个“管理员”账号。该账号的注册只能通过东润智慧渔业管理平台系统（以下简称“系统”）创建和发放，并与系统保持一致。系统有权根据用户需求或产品需要对账号注册的方式进行变更，无需事先通知用户。
2、如果注册申请者有被系统封禁的先例或涉嫌虚假注册及滥用他人名义注册，及其他不能得到许可的理由，系统将拒绝其注册申请。
3、鉴于“管理员”账号的注册方式,您同意系统在注册时将允许您的手机号码及手机设备识别码等信息用于注册。
4、在用户注册及使用本服务时,系统需要搜集能识别用户身份的个人信息以便系统可以在必要时联系用户,或为用户提供更好的使用体验。
三、账户安全
1、用户一旦注册成功,成为APP的用户,将得到一个用户名和密码,并有权利使用自己的用户名及密码随时进行登陆APP。
2、用户对用户名和密码的安全负全部责任,同时对以其用户名进行的所有活动和事件负全责。
3、用户不得以任何形式擅自转让或授权他人使用自己的APP用户名。
4、用户对密码加以妥善保管,切勿将密码告知他人,因密码保管不善而造成的所有损失由用户自行承担。
5、如果用户泄漏了密码,有可能导致不利的法律后果,因此不管任何原因导致用户的密码安全受到威胁,应该立即和APP负责人员或系统管理员取得联系,否则后果自负。
四、用户声明与保证
1、用户承诺其为具有完全民事行为能力的民事主体,且具有达成交易履行其义务的能力。
2、用户有义务在注册时提供自己的真实资料,并保证诸如手机号码、姓名、所在地区等内容的有效性及安全性,保证APP工作人员可以通过上述联系方式与用户取得联系。同时,用户也有义务在相关资料实际变更时及时更新有关注册资料。
3、用户通过使用APP的过程中所制作、上载、复制、发布、传播的任何内容,包括但不限于账号头像、名称、用户说明等注册信息及认证资料,或文字、语音、图片、视频、图文等发送、回复和相关链接页面,以及其他使用账号或本服务所产生的内容,不得违反国家相关法律制度,包含但不限于如下原则:
(1)违反宪法所确定的基本原则的；
(2)危害国家安全,泄露国家秘密,颠覆国家政权,破坏国家统一的；
(3)损害国家荣誉和利益的；
(4)煽动民族仇恨、民族歧视,破坏民族团结的；
(5)破坏国家宗教政策,宣扬邪教和封建迷信的；
(6)散布谣言,扰乱社公秩序,破坏社会稳定的；
(7)散布淫秽、色情、赌博、暴力、凶杀、恐怖或者教唆犯罪的；
(8)侮辱或者诽谤他人,侵害他人合法权益的；
(9)含有法律、行政法规禁止的其他内容的。
五、服务内容
1、APP是由山东东润科技股份有限公司提供的在线监测管理 东润智慧渔业数据的平台,用户通过APP查看或操作数据后,对数据库进行对应的修改，具体服务内容由APP根据实际情况提供,包括但不限于:
(1)在线查询、浏览、新增、修改、删除服务；
(2)推送服务；
2、APP有权随时审核或删除用户发布/传播的涉嫌违法或违反社会主义精神文明,或者被APP认为不妥当的内容(包括但不限于文字、语音、图片、视频图文等)。
用户通过APP查看或操作数据基本准则：
(1)在系统管理员分配的权限下；
(2)不可随意操作；
(3)APP提供的服务无法解决的问题，联系APP工作人员或登录系统平台操作；
六、服务的终止
1、在下列情况下,APP有权终止向用户提供服务：
（1）在用户违反本服务协议相关规定时，APP有权终止向该用户提供服务；如该用户再一次直接或间接或以他人名义注册为用户的，一经发现，APP有权直接单方面终止向该用户提供服务；
（2）用户不得通过程序或人工方式进行刷量或作弊，若发现用户有作弊行为，APP将立即终止服务；
（3）服务合同终止或到期时，APP将立即终止服务；
（4）以及其他APP认为需要终止服务的情况。
2、服务终止后，APP没有义务为用户保留原账号中或与之相关的任何信息，或转发任何未曾阋读或发送的信息给用户或第三方。
3、用户理解并同意，即便在本协议终止及用户的服务被终止后，APP仍有权：
（1）继续保存您的用户信息；
（2）继续向用户主张在其使用系统平台服务期间因违反法律法规、本协议及平台规则而应承担的责任。
七、服务的变更、中断
1、鉴于网络服务的特殊性，用户需同意APP会变更、中断部分或全部的网络服务，并删除（不再保存）用户在使用过程中提交的任何资料，而无需通知用户，也无需对任何用户或任何第三方承担任何责任。
2、APP需要定期或不定期地对提供网络服务的平台进行检测或者更新，如因此类情况而造成网络服务在合理时间内的中断，APP无需为此承担任何责任。
八、服务条款修改
1、APP有权随时修改本服务条款的任何内容，一旦本服务条款的任何内容发生变动，APP将会通过适当方式向用户提示修改内容。
2、如果不同意APP对本服务条款所做的修改，用户有权停止使用网络服务。
3、如果用户继续使用网络服务，则视为用户接受APP对本服务条款所做的修改。
九、免责与赔偿声明
1、若APP已经明示其服务提供方式发生变更并提醒用户应当注意事项，用户未按要求操作所产生的一切后果由用户自行承担。
2、用户明确同意其使用APP所存在的风险将完全由其自己承担，因其使用APP而产生的一切后果也由其自己承担。
3、用户同意保障和维护APP及其他用户的利益，由于用户在使用APP有违法、不真实、不正当、侵犯第三方合法权益的行为，或用户违反本协议项下的任何条款而给APP及任何其他第三方造成损失，用户同意承担由此造成的损害赔偿责任。
十、隐私声明
1、适用范围：
（1）在用户注册APP账户时，根据要求提供的个人注册信息；
（2）在用户使用APP时，APP自动接收并记录的用户浏览器上的服务器数值，包括但不限于IP地址等数据及用户要求取用的网页记录。
2、信息使用：
（1）APP不会向任何人出售或出借用户的个人信息，除非事先得到用户的许可；
（2）APP亦不允许任何第三方以任何手段收集、编辑、出售或者无偿传播用户的个人信息。任何用户如从事上述活动，一经发现，APP有权立即终止与该用户的服务协议，查封其账号；
（3）为达到服务用户的目的，APP可能通过使用用户的个人信息，向用户提供服务，包括但不限于向用户发出产品和服务信息，或者与APP合作伙伴共享信息以便他们向用户发送有关其产品和服务的信息。
3、信息披露：用户的个人信息将在下述情况下部分或全部被披露：
（1）经用用户同意，向第三方披露；
（2）根据法律的有关规定，或者行政或司法机构的要求，向第三方或者行政、司法机构披露；
（3）如果用户出现违反中国有关法律或者网站政策的情况，需要向第三方披露；
（4）为提供用户所要求的产品和服务，而必须和第三方分享用户的个人信息；
（5）其它APP根据法律或者网站政策认为合适的披露；
十一、其他
1、APP郑重提醒用户注意本协议中免除APP责任和限制用户权利的条款，请用户仔细阅读，自主考虑风险。未成年人应在法定监护人的陪同下阅读本协议。
2、本协议的效力、解释及纠纷的解决，适用于中华人民共和国法律。若用户和APP之间发生任何纠纷或争议，首先应友好协解决，协商不成的，用户同意将纠纷或争议提交APP住所地有管辖权的人民法院管辖。
3、本协议的任何条款无论因何种原因无效或不具可执行性，其余条款仍有效，对双方具有约束力。
4、本协议最终解释权归山东东润仪表科技股份有限公司所有，并且保留一切解释和修改的权力。
5、本协议自2022年3月1日起适用。

Once the updated agreement terms are published, they will replace the original agreement terms without further notice. Users can check the latest version of the agreement terms in this APP. After modifying the terms of the agreement, if the user does not accept the modified terms, please immediately stop using the services provided by the APP. If the user continues to use the services provided by the APP, it will be deemed to accept the modified agreement
II. Account registration
1. Users need to register an "administrator" account before using this service. The registration of this account can only be created and distributed through the Dongrun Portable Monitoring management platform system (hereinafter referred to as the "system"), and is consistent with the system. The system has the right to change the method of account registration according to user needs or product needs without prior notice to users
2. If the registration applicant has the precedent of being banned by the system or is suspected of false registration and misusing the name of others, and other reasons for not obtaining permission, the system will refuse its registration application
3. In view of the registration method of the "administrator" account, you agree that the system will allow your mobile phone number and mobile device identification code to be used for registration
4. When users register and use this service, the system needs to collect personal information that can identify users so that the system can contact users when necessary, or provide users with a better use experience
III. Account security
1. Once the user has registered successfully, the user who becomes an APP user will get a user name and password, and have the right to log in to the APP at any time using his own user name and password
2. The user is fully responsible for the security of the user name and password, and for all activities and events conducted with his user name
3. Users shall not transfer or authorize others to use their own APP user name in any form without authorization
4. The user shall keep the password properly and shall not inform others of the password. All losses caused by improper storage of the password shall be borne by the user
5. If the user discloses the password, it may lead to adverse legal consequences. Therefore, regardless of the threat to the user's password security caused by any reason, you should immediately contact the person in charge of the APP or the system administrator, otherwise you should bear the consequences
IV. User's statement and warranty
1. The user promises that he/she is a civil subject with full civil capacity and has the ability to conclude a transaction and fulfill his/her obligations
2. Users are obliged to provide their true information at the time of registration, and ensure the validity and security of contents such as mobile phone number, name, location, etc., and ensure that APP staff can contact users through the above contact methods. At the same time, users are also obliged to update the relevant registration information in time when the relevant information is actually changed
3. Any content produced, uploaded, copied, published and disseminated by users in the process of using the APP, including but not limited to registration information and authentication information such as account avatar, name, user description, or text, voice, image, video, image and other sending, reply and related link pages, as well as other content generated by using the account or the service, shall not violate the relevant national laws and regulations, including but not limited to the following principles:
(1) Violating the basic principles set forth in the Constitution
(2) Endangering national security, disclosing state secrets, subverting state power, and undermining national unity
(3) Damage to national honor and interests
(4) Inciting national hatred and discrimination and undermining national unity
(5) Those who undermine the state's religious policies and promote heresy and feudal superstition
(6) Spreading rumors, disturbing social order and undermining social stability

V. Service content
1. APP is an online monitoring and management platform for Dongrun Portable Monitoring data provided by Shandong Dongrun Technology Co., Ltd. Users can modify the database after viewing or operating the data through the APP. The specific service content is provided by the APP according to the actual situation, including but not limited to:
(1) Online query, browse, add, modify and delete services
(2) Push service
2. APP has the right to review or delete the contents (including but not limited to text, voice, pictures, video, etc.) that are suspected to be illegal or violate the socialist spiritual civilization or deemed inappropriate by APP
Basic rules for users to view or operate data through APP:
(1) Under the authority assigned by the system administrator
(2) Do not operate at will
(3) For problems that cannot be solved by the services provided by APP, contact the APP staff or log in to the system platform for operation
VI. Service termination
1. APP has the right to terminate the service provided to users under the following circumstances:
(1) When a user violates the relevant provisions of this service agreement, APP has the right to terminate the service provided to the user; If the user registers as a user directly or indirectly or in the name of another person again, once found, APP has the right to directly and unilaterally terminate the service provided to the user
(2) Users are not allowed to swipe or cheat through procedures or manual methods. If users are found to cheat, APP will immediately terminate the service
(3) When the service contract is terminated or expires, APP will immediately terminate the service
(4) And other situations where APP deems it necessary to terminate the service
2. After the service is terminated, APP has no obligation to retain any information in or related to the original account for the user, or forward any information that has not been read or sent to the user or a third party
3. The user understands and agrees that even after the termination of this agreement and the termination of the user's service, APP still has the right to:
(1) Continue to save your user information
(2) Continue to claim the responsibility of users for violating laws and regulations, this agreement and platform rules during their use of system platform services
VII. Change and interruption of service
1. In view of the particularity of network services, users need to agree that APP will change, interrupt part or all of the network services, and delete (no longer save) any information submitted by users in the process of use, without notifying users, nor taking any responsibility for any users or any third party
2. APP needs to detect or update the platform providing network services regularly or irregularly. If the network service is interrupted within a reasonable time due to such circumstances, APP does not need to bear any responsibility for this
VIII. Modification of service terms
1. APP has the right to modify any content of the Terms of Service at any time. Once any content of the Terms of Service changes, APP will prompt the user to modify the content in an appropriate way
2. If you do not agree with the changes made by APP to the terms of service, the user has the right to stop using the network service
3. If the user continues to use the network service, it is deemed that the user has accepted the changes made by APP to the terms of service
IX. Disclaimer and Indemnity Statement
1. If APP has indicated that its service delivery mode has changed and reminded the user of precautions, all consequences arising from the user's failure to operate as required shall be borne by the user
2. The user expressly agrees that the risk of using the APP will be entirely borne by him, and all consequences arising from his use of the APP will also be borne by him
3. The user agrees to protect and safeguard the interests of APP and other users. The user agrees to bear the liability for damages caused to APP and any other third party due to the user's illegal, untrue, improper, and infringement of the legitimate rights and interests of the third party when using the APP, or the user's violation of any term under this agreement
10. Privacy Statement
1. Scope of application:
(1) The personal registration information provided according to the requirements when the user registers the APP account
(2) When the user uses the APP, the APP automatically receives and records the server values on the user's browser, including but not limited to the IP address and other data and the web page records required by the user
2. Information use:
(1) APP will not sell or lend the user's personal information to anyone, unless the user's permission is obtained in advance
(2) APP also does not allow any third party to collect, edit, sell or disseminate user's personal information free of charge by any means. If any user engages in the above activities, once found, APP has the right to immediately terminate the service agreement with the user and seal up his/her account
(3) In order to serve users, APP may provide services to users by using their personal information, including but not limited to sending product and service information to users, or sharing information with APP partners so that they can send information about their products and services to users
3. Information disclosure: The user's personal information will be disclosed in part or in whole under the following circumstances:
(1) Disclose to a third party with the consent of the user
(2) Disclose to a third party or an administrative or judicial body in accordance with the relevant provisions of the law or the requirements of the administrative or judicial body
(3) If the user violates the relevant Chinese laws or website policies, it needs to be disclosed to a third party
(4) In order to provide the products and services required by users, the user's personal information must be shared with a third party
(5) Other disclosures deemed appropriate by APP according to laws or website policies
11. Others
1. APP solemnly reminds users of the clauses in this agreement that exempt APP from liability and restrict users' rights. Please read them carefully and consider risks independently. Minors should read this agreement with the legal guardian
2. The validity, interpretation and dispute resolution of this agreement shall be governed by the laws of the People's Republic of China. In case of any dispute or dispute between the user and APP, it shall be settled amicably. If the negotiation fails, the user agrees to submit the dispute or dispute to the people's court with jurisdiction in the place where APP is located for jurisdiction
3. No matter what reason any provision of this agreement is invalid or unenforceable, the remaining provisions are still valid and binding on both parties
4. The final interpretation right of this agreement belongs to Shandong Dongrun Instrument Technology Co., Ltd., and reserves all rights of interpretation and modification
5. This agreement shall apply from March 1, 2025
